Terms of Service | Mintybug

These Terms of Service (“Terms”) govern your access to and use of the Mintybug platform at mintybug.ai (the “Platform”), operated by YANDE (“Company,” “we,” “us,” or “our”), a business registered in Singapore. By accessing or using the Platform, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, purchasing credits, or otherwise using the Platform, you confirm that you have read, understood, and agree to these Terms, our Privacy Policy, and our Cookie Policy. If you do not agree, you must not use the Platform.

We may update these Terms at any time by posting the revised version on the Platform. Continued use after changes are posted constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 18 years of age to use the Platform. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

Access to mature or NSFW content is restricted to users who are of legal age in their jurisdiction and have explicitly opted in to view such content.

3. User Accounts

3.1 Registration

You may create an account using email and password or through Google OAuth. You agree to provide accurate information and keep your account credentials confidential.

3.2 Account Responsibility

You are responsible for all activity that occurs under your account. Notify us immediately if you believe your account has been compromised.

3.3 Suspension and Termination

We may suspend or terminate your account at our discretion for violation of these Terms, fraudulent activity, or conduct harmful to other users or the Platform. You may close your account at any time through account settings.

4. Platform Description

Mintybug is an AI-powered interactive fiction and RPG platform with a two-sided creator marketplace. The Platform allows:

Creators to build story templates with structured RPG mechanics including characters, items, skills, classes, events, maps, world beings, organisations, forces, structures, and writing styles.

Players to generate unique AI-powered playthroughs by interacting with templates through a turn-based system.

Both to participate in a marketplace where creators earn revenue from template plays and players can publish completed stories.

5. Credits and Payments

5.1 Virtual Currency

The Platform uses a credit-based system. Credits are required to generate AI content, start playthroughs, and access premium features. Credits have no monetary value outside the Platform except where creator payout provisions apply.

5.2 Purchasing Credits

Credits may be purchased in packages through Stripe. All credit purchases are final and non-refundable, except as required by applicable law. Available packages and pricing are displayed on the Platform and may change at any time.

5.3 Promotional Credits

New users may receive complimentary credits upon registration. Promotional credits may have expiration dates or usage restrictions and are non-transferable.

5.4 Credit Expiry and Forfeiture

Unused credits remaining in your account upon account termination will be forfeited. We reserve the right to introduce credit expiration policies with reasonable advance notice.

6. Creator Economy

6.1 Earning Revenue

Creators earn a share of credits spent by Players on their published templates. The revenue split between creators and the Platform is published on the Platform and may be adjusted from time to time with notice.

6.2 Payout Requirements

To receive monetary payouts, creators must complete Stripe Connect onboarding, maintain a verified account in good standing, and meet the minimum withdrawal threshold. Earnings are subject to a hold period before becoming eligible for withdrawal.

6.3 Taxes

Creators are solely responsible for all tax obligations arising from their earnings. We may collect tax information and report earnings to tax authorities as required by law.

6.4 Revenue Adjustments

We reserve the right to reverse or adjust creator earnings in cases of fraud, chargebacks, Terms violations, or credit abuse.

7. AI-Generated Content

7.1 Nature of AI Content

The Platform uses third-party AI providers (including OpenAI, Anthropic, Google, DeepSeek, and xAI) to generate story content. AI-Generated Content is produced by automated systems and may contain inaccuracies, unexpected output, or content that does not match your expectations.

7.2 No Guarantees

We do not guarantee the quality, accuracy, appropriateness, or availability of AI-Generated Content. AI provider availability may vary, and we may add, remove, or change providers at any time.

7.3 AI Provider Selection

Players may select their preferred AI provider for content generation, subject to availability. Certain providers may only be available for specific content types (e.g., NSFW content is restricted to designated providers only).

8. Intellectual Property

8.1 Platform IP

All Platform software, design, branding, and technology are owned by YANDE. These Terms grant you a limited, non-exclusive, non-transferable licence to use the Platform for its intended purpose.

8.2 Creator Content

Creators retain ownership of the original creative elements of their templates. By publishing a template, you grant YANDE a non-exclusive, worldwide, royalty-free licence to host, display, distribute, and make the template available through the Platform.

8.3 Player Content

Players receive a licence to use, display, and publish their playthroughs within the Platform. Playthroughs are collaborative works derived from creator templates, player inputs, and AI generation.

8.4 AI Content Ownership

The legal ownership of AI-generated content is an evolving area of law. Our current policy allocates usage rights as described in this section, but we reserve the right to update this policy as legal frameworks develop. This section is not legal advice regarding your rights to AI-generated content outside the Platform.

8.5 Restrictions

You must not include third-party copyrighted material in templates without proper authorisation. You must not use Platform content to train competing AI models without our written consent.

9. Prohibited Conduct

You agree not to:

Violate any applicable law or regulation.

Upload or generate unlawful, defamatory, threatening, or harassing content.

Attempt to access other users’ accounts or circumvent Platform security.

Use bots, scripts, or automated tools to access the Platform beyond normal use.

Manipulate the credit system, ratings, reviews, or marketplace.

Reverse engineer, decompile, or scrape any part of the Platform.

Impersonate any person or entity.

Post fraudulent or incentivised reviews.

Harass, threaten, or abuse other users.

Use the Platform for any purpose that competes with or undermines Mintybug.

10. Content Moderation

We employ automated AI-based moderation and may conduct human review of content on the Platform. We reserve the right to remove content, issue warnings, or suspend accounts for content that violates these Terms or our content policies. Content moderation decisions are made at our sole discretion.

The Platform supports user reporting of objectionable content. Repeated or egregious violations may result in permanent account termination.

11. NSFW Content

The Platform may permit mature or NSFW content under designated conditions:

NSFW content is only accessible to users who have confirmed they are of legal age and have opted in.

NSFW content generation is restricted to designated AI providers.

We reserve the right to restrict, modify, or disable NSFW features in any jurisdiction where such content may be prohibited or regulated.

Creators must accurately tag content that contains mature themes.

Regardless of content rating, the following content is strictly prohibited: content depicting minors in sexual situations, content that promotes violence against specific real individuals, and content that violates applicable law.

12. Third-Party Services

The Platform integrates with third-party services including AI providers (OpenAI, Anthropic, Google, DeepSeek, xAI, MiniMax), payment processing (Stripe), authentication providers (Google), and analytics services (PostHog, Axiom). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party service availability, performance, or practices.

13. Disclaimers

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR APPROPRIATE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YANDE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) SGD 100.

15. Indemnification

You agree to indemnify and hold harmless YANDE from any claims, damages, or expenses arising from your use of the Platform, your content, your violation of these Terms, or your infringement of any third-party rights.

16. Dispute Resolution

These Terms are governed by the laws of Singapore. Before filing any formal proceedings, you agree to attempt informal resolution by contacting us for at least thirty (30) days. Disputes that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the courts of Singapore.

17. General Provisions

Entire Agreement: These Terms, the Privacy Policy, and Cookie Policy constitute the entire agreement between you and YANDE.

Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

Waiver: Failure to enforce any provision does not constitute a waiver.

Assignment: You may not assign your rights under these Terms. We may assign freely.

Force Majeure: We are not liable for failures caused by events beyond our reasonable control.
